This agreement is made and entered into as of 1/25/21
By and between My Amazing Wedding Dress INC and Purchaser and Adila
1. Sale and Purchase Subject to the provisions set forth in this agreement, the seller agrees to sell to the buyer, and the buyer agrees to purchase from the seller a custom-made off-white wedding dress with a lace top and chiffon skirt (Scoop neckline and see-through sleeves)
2. Purchase Price
The purchase for the above item(s) is $750.The purchase price shall be paid as follows.
(i) _$ _375________Down payment (deposit)
(ii) _$ 375________After the dress is completed and ready to ship.
(iii) _ $100__________ Shipping and handling.( due together with the final payment)
3. TRANSFER OF POSSESSION. Buyer and seller agree, subject to the fulfillment of the buyers’ obligations set forth in section 2 above, that all risk, possession, and transfer of full ownership will be effective when the Purchase Price has been paid in full. Down payment (2i) needs to be paid before any work is started. The Amount Due (ii, iii) has to be paid before shipping the dress.
4. Completion.
4.1 The Estimated completion date is TBD ( 12 weeks from the time when measurement provided) do not expect the dress before this date. Do not plan your bridal photos or anything that will require your dress before this date. Sometimes there are unforeseen circumstances that may delay the production of the dress.
5. WARRANTIES
5.1 Dress size and alterations.
The dress is sold “as is”. We do not do alterations of any kind. While we do our best to build the dress as close as possible to your measurements, we do NOT do fittings, and because brides may change in shape and size the dress might need some alterations. Be prepared for this and plan accordingly. If alterations are needed, you can always get it altered by your local bridal seamstress, which is standard practice in the bridal industry for that perfect fit. Alterations of any kind ARE NOT included in the price and you must pay for your own alterations. We recommend getting your dress plenty of time before the wedding to be prepared for any last-minute circumstances.
6. Return policy.
If you decide to return the dress, it must be returned to us within 7 days of delivery. The dress must be returned in the same perfect, unused condition as it was shipped to you. Item must not have been worn, altered, dirtied, or damaged in any way, or you maybe 100% liable for the dress. All tags must be left on the item. The buyer is responsible for all shipping costs.
Refundable amounts.
Your final payment amount (2ii) is refundable.
The dress deposit (2i) is non-refundable. (This amount shall be kept as a restocking fee)
Understand that for us to make any dress takes a significant amount of time and labor. If we are making a dress specifically for you, your style, and your measurements and it is returned, it may take us a significant amount of time and effort to resell the dress or we might not be able to recover our cost. Hence we must charge a deposit and/or a restocking fee.
6.3 NONREFUNDABLE (The following items are non-refundable)
i. All deposits are NON- refundable if you change your mind after 24 hours.
ii. If we begin making a dress for you and the wedding is called off, or you find another dress, or you simply don’t want a dress anymore we cannot refund your deposit.
iii. Shipping cost.
